1. About NEXT
NEXT is a customs declaration management platform operated by OTS Broker Ltd ("we", "us", "our"). NEXT enables authorised users to prepare, validate, and submit UK customs declarations to HMRC via the Customs Declaration Service (CDS) and the New Computerised Transit System (NCTS5).

2. Scope of Service
NEXT supports the following declaration types for UK customs:
NEXT is currently used for internal operations by OTS Broker Ltd. Access is restricted to authorised personnel only.
3. Authorised Access
Access to NEXT is granted solely at the discretion of OTS Broker Ltd. You may only use NEXT if you have been provided with valid credentials by us. You must:
- Keep your login credentials confidential and secure.
- Not share your account with any other person.
- Notify us immediately if you suspect unauthorised access to your account.
We may suspend or revoke access at any time without notice if we believe these terms have been breached.
4. User Responsibilities
You are responsible for:
- The accuracy and completeness of all declaration data you enter into NEXT.
- Ensuring that declarations comply with applicable customs legislation, including the Customs Act 2018 and the Taxation (Cross-border Trade) Act 2018.
- Reviewing declaration data before submission to HMRC.
- Retaining your own records as required by law.
NEXT provides validation checks and guidance to assist you, but these do not substitute for your own professional judgement and legal obligations as a customs declarant or broker.
5. No Guarantee of HMRC Acceptance
Submission of a declaration through NEXT does not guarantee acceptance by HMRC. A declaration may be:
We make reasonable efforts to ensure XML payloads conform to HMRC's published schemas, but we cannot guarantee that every submission will pass HMRC's business rules.
6. Limitation of Liability
To the maximum extent permitted by law:
- NEXT is provided "as is" without warranties of any kind, whether express or implied.
- We do not warrant that NEXT will be uninterrupted, error-free, or free from security vulnerabilities.
- We are not liable for any losses arising from HMRC rejection, delayed processing, incorrect duty calculations, or penalties resulting from inaccurate declaration data.
- Our total liability for any claim arising from your use of NEXT shall not exceed the fees paid by you (if any) in the 12 months preceding the claim.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
7. Intellectual Property
NEXT, including its source code, design, and documentation, is the intellectual property of OTS Broker Ltd. You may not copy, modify, distribute, or reverse-engineer any part of NEXT without our written consent.
8. Data Protection
Your use of NEXT is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with UK GDPR.
9. Service Availability
We aim to keep NEXT available at all times but do not guarantee uninterrupted service. We may need to suspend access for maintenance, updates, or security reasons. Where possible, we will provide advance notice of planned downtime.
NEXT depends on external systems operated by HMRC (CDS and NCTS5). We are not responsible for outages or degraded performance of HMRC systems.
10. Termination
We may terminate or suspend your access to NEXT at any time, with or without cause. Upon termination, your right to use NEXT ceases immediately. Provisions relating to liability, intellectual property, and governing law survive termination.
11. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via the platform. Continued use of NEXT after changes constitutes acceptance of the revised terms.
12. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from your use of NEXT shall be subject to the exclusive jurisdiction of the courts of England and Wales.
